TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the Maxximus AI platform, including our website at maxximus.ai, mobile applications (iOS and Android), AI coaching services, The Forum community, and any related services (collectively, the "Service"), operated by MaxximusAI, Inc. ("Maxximus," "we," "us," or "our"), a Delaware corporation.

By accessing or using the Service — including by downloading our mobile application — you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not access or use the Service.

For terms specific to our AI coaching features, please also review our AI Coaching Terms.

1. ELIGIBILITY

To use Maxximus, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable law
• Not have been previously suspended or removed from the Service

By using the Service, you represent and warrant that you meet all eligibility requirements. By creating an account, you self-attest that you are 18 years of age or older. We do not knowingly allow users under 18 to access the Service.

2. ACCOUNTS

When you create an account with Maxximus, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account at support@maxximus.ai
• Accept responsibility for all activities that occur under your account

3. THE SERVICE — SCOPE AND LIMITATIONS

Maxximus provides AI-powered coaching for personal development, including dating, communication, confidence, and masculine development.

You acknowledge and agree that:

• Maxximus AI is an educational and coaching tool — it is not a licensed therapist, psychologist, medical provider, psychiatrist, or legal advisor
• You are not purchasing or receiving the services of a live human coach, counselor, or therapist — all coaching is delivered by artificial intelligence
• AI coaching responses are generated by artificial intelligence and may not be accurate, complete, or applicable to your specific situation
• You should not rely solely on Maxximus for decisions of significant personal, financial, medical, or legal consequence
• Results vary — we make no guarantees about specific outcomes in dating, relationships, confidence, or personal development

4. SUBSCRIPTIONS AND PAYMENT

4.1 Pricing

Maxximus offers a free tier and paid subscription plans. Current pricing is listed at maxximus.ai. Prices are subject to change with 30 days' notice to existing subscribers.

4.2 Billing

Paid subscriptions are billed in advance on a recurring monthly basis. By subscribing, you authorize us to charge your payment method on each renewal date. All direct payments are processed securely via Stripe.

4.3 App Store and Google Play Purchases

If you purchase a subscription through Apple's App Store or Google Play:

• Your subscription is managed by Apple or Google, not Maxximus directly
• For iOS: payment will be charged to your Apple ID at confirmation of purchase. Your subscription automatically renews unless auto-renew is turned off at least 24 hours before the end of the current period. Manage subscriptions in your Apple ID Account Settings.
• For Android: payment will be charged to your Google account at confirmation. Manage subscriptions through your Google Play account.
• Refunds for App Store or Google Play purchases must be requested through Apple or Google respectively, not Maxximus

4.4 Cancellation — Direct Subscriptions

If you subscribe directly through maxximus.ai, you may cancel at any time. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial periods. To cancel: log in > Account Settings > Manage Subscription > Cancel, or email support@maxximus.ai with "SUBSCRIPTION CANCELLATION" in the subject line.

Notice of Cancellation Rights: In some jurisdictions, you may have additional statutory cancellation or cooling-off rights. Nothing in these Terms limits any statutory rights you may have under applicable law.

4.5 72-Hour Cancellation Right

You may cancel any direct paid subscription within 72 hours of initial purchase for a full refund, provided you have not used more than 10 AI coaching interactions during that period. Contact support@maxximus.ai with "72-HOUR CANCELLATION" in the subject line within 72 hours of purchase.

4.6 Satisfaction Guarantee

We offer a 7-day satisfaction guarantee for first-time paid subscribers purchasing directly through maxximus.ai. If not satisfied within your first 7 days, contact support@maxximus.ai for a full refund.

5. THE FORUM — COMMUNITY CONDUCT

5.1 Prohibited Content

You may NOT post content that:

• Is harassing, threatening, abusive, defamatory, or bullying toward any person
• Contains hate speech or discrimination based on race, gender, religion, sexual orientation, or other protected characteristics
• Promotes, glorifies, or instructs in violence, illegal activity, or self-harm
• Is sexually explicit, pornographic, or inappropriate
• Constitutes spam, commercial solicitation, or unsolicited advertising
• Contains another person's personal information without their consent (doxxing)
• Violates any third party's intellectual property rights, including copyrighted content posted without permission
• Promotes manipulation, exploitation, or psychological harm of others
• Is posted by a minor or depicts minors in any inappropriate context

5.2 Moderation Rights and CDA Section 230

Maxximus reserves the right, at our sole discretion and without prior notice, to remove content that violates these Terms, and to suspend or permanently ban any user. We are not obligated to monitor The Forum at all times but reserve the right to do so.

As an interactive computer service under 47 U.S.C. § 230, Maxximus is not the publisher or speaker of user-generated content posted in The Forum and is not liable for content posted by users.

Repeat Infringer Policy: Maxximus will terminate accounts of users found to be repeat infringers of third-party intellectual property rights.

6. ACCEPTABLE USE

You agree NOT to use the Service to:

• Violate any applicable law or regulation
• Harass, abuse, threaten, stalk, or harm any person
• Submit false, misleading, or fraudulent information
• Scrape, crawl, or extract data from the Service without authorization
• Reverse engineer, decompile, or attempt to extract source code
• Circumvent security measures or access systems you are not authorized to use
• Use the Service for any commercial purpose without our written consent
• Impersonate any person or entity
• Transmit viruses, malware, or other harmful code
• Attempt to manipulate, jailbreak, or override the AI coaching system's guidelines or safety features

7. INTELLECTUAL PROPERTY

7.1 Our Property

The Service, including all content, features, functionality, design, code, AI models, coaching methodologies, the "Maxximus" name and brand, and all associated intellectual property are owned by MaxximusAI, Inc. and protected by United States and international intellectual property laws.

7.2 Your Content

You retain ownership of content you submit to the Service. By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process that content solely to provide and improve the Service.

7.3 Feedback

If you submit feedback, suggestions, or ideas about the Service, you grant us the right to use that feedback without restriction or compensation to you.

8. DMCA — COPYRIGHT INFRINGEMENT

If you believe content on our Service infringes your copyright, send a written notice to legal@maxximus.ai containing:

1. Your physical or electronic signature
2. Identification of the copyrighted work you claim has been infringed
3. Identification of the infringing material with enough detail to locate it
4. Your contact information
5. A good faith belief statement that the use is not authorized
6. A statement under penalty of perjury that your notice is accurate and you are authorized to act

9. THIRD-PARTY INTEGRATIONS

The Service integrates with third-party platforms and services. Key integrations include:

• xAI (Grok) — AI language model powering coaching responses
• Apple — iOS app distribution, Apple Sign In, and if applicable, in-app purchases
• Google — Android app distribution, Google Sign In, and if applicable, in-app purchases
• Stripe — payment processing for direct subscriptions
• Meta (Instagram/Facebook) — web platform only, for business social media management (not present in the mobile application)

Your use of any third-party platform is governed by that platform's own terms. We are not responsible for the availability, accuracy, or conduct of third-party platforms.

You agree to indemnify, defend, and hold harmless MaxximusAI, Inc., its officers, directors, employees, agents, and AI service providers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: your use of the Service; your violation of these Terms; your violation of any third-party rights; content you post in The Forum; any adverse results you experience as a result of acting on AI coaching responses; or your violation of any applicable law in connection with your use of the Service.

13. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute shall first be attempted to be resolved through good faith informal negotiation. If not resolved within 30 days, disputes shall be resolved through binding individual arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules. Arbitration shall take place in Palm Beach County, Florida or by remote proceeding.

Class Action Waiver: You expressly waive the right to participate in a class action lawsuit or class-wide arbitration. All disputes must be brought in your individual capacity only.

California Residents: Notwithstanding the above, California residents may have the right to bring certain consumer claims in small claims court. Nothing in this arbitration clause limits any right you may have under California law that cannot be waived by contract.

EU/EEA Residents: If you are located in the EU or EEA, the mandatory arbitration and class action waiver provisions above do not apply to you. You retain the right to bring claims before the courts of your country of residence and before your local data protection supervisory authority.

14. TERMINATION

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time through Settings > Account > Delete Account or by contacting support@maxximus.ai.

Upon termination, your right to use the Service immediately ceases. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and dispute resolution.

15. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting an updated version on this page and updating the "Last Updated" date. For significant changes affecting your rights, we will also notify registered users by email or in-app notification at least 7 days before the change takes effect. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

16. MISCELLANEOUS

• Entire Agreement: These Terms, together with our Privacy Policy and AI Coaching Terms, constitute the entire agreement between you and Maxximus regarding the Service
• Severability: If any provision is found unenforceable, the remaining provisions continue in full force
• Waiver: Our failure to enforce any right will not be deemed a waiver
• Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights freely, including in connection with a merger or acquisition.
• Force Majeure: We are not liable for delays or failures caused by circumstances beyond our reasonable control
