TERMS OF SERVICE

These Terms of Service ("Terms") govern your access to and use of the Maxximus AI platform, including our website at maxximus.ai, mobile applications, AI coaching services, and any related services (collectively, the "Service"), operated by MaxximusAI, Inc. ("Maxximus," "we," "us," or "our"), a Delaware corporation.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not access or use the Service.

1. ELIGIBILITY

To use Maxximus, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into a binding agreement
• Not be prohibited from using the Service under applicable law
• Not have been previously suspended or removed from the Service

2. ACCOUNTS

When you create an account with Maxximus, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized use of your account
• Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we believe pose a risk to the integrity of the Service.

3. THE SERVICE — AI COACHING

Maxximus provides AI-powered coaching for personal development, including but not limited to dating, communication, confidence, and masculine development. You acknowledge and agree that:

• Maxximus AI is an educational and coaching tool — it is not a licensed therapist, psychologist, medical provider, or legal advisor
• AI coaching responses are generated by artificial intelligence and may not be accurate, complete, or applicable to your specific situation
• You should not rely solely on Maxximus for decisions of significant personal, financial, medical, or legal consequence
• The AI may occasionally generate responses that are imperfect, incomplete, or require human judgment
• Results vary — we make no guarantees about specific outcomes in dating, relationships, or personal development

3.1 Preview Program

From time to time, Maxximus may offer a limited-access preview program. If you access the Service through a preview program, the following terms apply in addition to the rest of this Section 3:

• Limited access. Preview access is capped at a fixed number of AI coaching interactions (currently 25 messages). Once you reach that limit, your preview session concludes and you will receive information about full Service access when available.
• Feedback collection. As part of the preview program, we collect per-message ratings and the content of rated messages, as well as optional free-text session feedback, to evaluate and improve the quality of our AI coaching. By participating in the preview program, you acknowledge and consent to this collection as described in our Privacy Policy.
• No guarantee of future access. Participation in the preview program does not guarantee access to the full Service or any specific pricing tier upon general availability.
• Modification or termination. We reserve the right to modify, suspend, or terminate the preview program at any time without prior notice.

4. SUBSCRIPTIONS AND PAYMENT

4.1 Pricing

Maxximus offers a free tier and paid subscription plans. Current pricing is listed on our website at maxximus.ai. Prices are subject to change with 30 days notice.

4.2 Billing

Paid subscriptions are billed in advance on a recurring monthly basis. By subscribing, you authorize us to charge your payment method on each renewal date. All payments are processed securely via Stripe.

4.3 Cancellation

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial periods.

4.4 Refunds

We offer a 7-day satisfaction guarantee for first-time subscribers. If you are not satisfied within your first 7 days of a paid subscription, contact us at support@maxximus.ai for a full refund.

5. ACCEPTABLE USE

You agree NOT to use the Service to:

• Violate any applicable law or regulation
• Harass, abuse, threaten, stalk, or harm any person
• Promote violence, exploitation, discrimination, or illegal activity
• Submit false, misleading, or fraudulent information
• Attempt to manipulate, deceive, or coerce others in harmful ways
• Scrape, crawl, or extract data from the Service without authorization
• Reverse engineer, decompile, or attempt to extract source code
• Circumvent security measures or access systems you are not authorized to use
• Use the Service for any commercial purpose without our written consent
• Impersonate any person or entity
• Transmit viruses, malware, or other harmful code
• Interfere with or disrupt the integrity or performance of the Service

Maxximus reserves the right to terminate your access immediately and without notice for violations of this section.

6. INTELLECTUAL PROPERTY

6.1 Our Property

The Service, including all content, features, functionality, design, code, AI models, coaching methodologies, the "Maxximus" name and brand, and all associated intellectual property are owned by MaxximusAI, Inc. and protected by United States and international intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, service marks, or logos without our prior written consent.

6.2 Your Content

You retain ownership of content you submit to the Service (your coaching conversations, profile information, etc.). By submitting content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process that content solely to provide and improve the Service.

6.3 Feedback

If you submit feedback, suggestions, or ideas about the Service, you grant us the right to use that feedback without restriction or compensation to you.

7. THIRD-PARTY INTEGRATIONS

The Service integrates with third-party platforms including Meta (Instagram, Facebook), TikTok, and others. Your use of those platforms is governed by their respective terms of service. We are not responsible for the availability, accuracy, or conduct of third-party platforms.

When you authorize our application to access your social media accounts, you are subject to those platforms' terms in addition to ours. We access only the permissions you explicitly grant and use that access solely for the purposes described in our Privacy Policy.

8. DISCLAIMERS

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

TO THE FULLEST EXTENT PERMITTED BY LAW, MAXXIMUS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR FREE OF VIRUSES. WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR USEFULNESS OF ANY INFORMATION PROVIDED THROUGH THE SERVICE.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, MAXXIMUS AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES
• DAMAGES ARISING FROM YOUR RELIANCE ON AI-GENERATED COACHING CONTENT
• DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR DATA

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) $100 USD.

10. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless MaxximusAI, Inc., its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your use of the Service, violation of these Terms, or violation of any third-party rights.

11. GOVERNING LAW AND DISPUTES

These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any dispute arising from or relating to these Terms or the Service shall first be attempted to be resolved through informal negotiation. If not resolved within 30 days, disputes shall be resolved through binding arbitration in accordance with the American Arbitration Association's Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction.

Class Action Waiver: You waive the right to participate in a class action lawsuit or class-wide arbitration against Maxximus.

12. TERMINATION

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, including for violation of these Terms. Upon termination:

• Your right to use the Service immediately ceases
• We may delete your account data in accordance with our Privacy Policy
• Provisions that by their nature should survive termination will survive (including intellectual property, disclaimers, limitation of liability, and dispute resolution)

13. CHANGES TO TERMS

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting an updated version on this page and updating the "Last Updated" date. For significant changes, we will also notify registered users by email. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.

14. MISCELLANEOUS

• Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Maxximus regarding the Service
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force
• Waiver: Our failure to enforce any right or provision will not be deemed a waiver
• Assignment: You may not assign your rights under these Terms without our written consent. We may assign our rights freely
• Force Majeure: We are not liable for delays or failures caused by circumstances beyond our reasonable control
